These terms and conditions apply to direct bookings with Hibiscus Beach House Curaçao. By confirming a reservation or paying the required deposit, the guest confirms that they have read, understood and accepted these terms.
1. Reservation and confirmation
A reservation is only final once:
- Hibiscus Beach House has confirmed the reservation in writing; and
- the required deposit has been received.
The person making the reservation must be at least 18 years old and is responsible for the reservation, the payment and the conduct of all accompanying guests.
Hibiscus Beach House is an Adults Only property. All guests must be at least 18 years old, unless an exception has been expressly approved in writing in advance.
2. Rates and tourist tax
All rates are quoted in US dollars unless stated otherwise.
The applicable Curaçao tourist tax, currently 7%, is added unless it is expressly stated that it is included in the confirmed price.
The reservation confirmation states what is included in the rate.
Breakfast is included with room reservations. Breakfast is not included with studio apartment reservations, but can be added separately, subject to availability, at an additional charge of US$ 22 per person per day.
Additional services, including airport transfers, car rental, excursions and boat trips, are charged separately unless expressly stated otherwise.
3. Payment terms
To confirm the reservation, a non-refundable deposit of 25% of the total reservation amount is required.
The remaining balance must be received no later than six weeks before arrival.
For reservations made within six weeks of arrival, the full reservation amount is payable immediately.
Any costs for bank transfers, credit card payments or international transactions are for the account of the guest. The full invoiced amount must be received by Hibiscus Beach House.
If payment has not been received by the stated due date, Hibiscus Beach House reserves the right to cancel the reservation. Amounts already paid are treated in accordance with the cancellation policy.
4. Cancellation policy
All cancellations must be submitted in writing by email.
- For cancellations 60 days or more before arrival, the non-refundable deposit of 25% of the total reservation amount is retained.
- For cancellations between 30 and 59 days before arrival, 50% of the total reservation amount is charged.
- For cancellations less than 30 days before arrival, 100% of the total reservation amount is charged.
- In the event of a no-show, late arrival or early departure, no refund is given for unused nights or services.
An approved refund is, where reasonably possible, returned to the original payer using the same payment method. Non-recoverable bank or transaction charges may be deducted from the amount refunded.
Guests are strongly advised to take out comprehensive travel and cancellation insurance.
5. Changes to a reservation
Changes to the arrival or departure date can be requested up to 30 days before arrival. All changes are subject to availability and to written approval by Hibiscus Beach House.
A change is only confirmed once written confirmation has been provided. Any difference in accommodation costs, tourist tax or other applicable charges must be paid by the guest.
Requests to change a reservation less than 30 days before arrival are handled in accordance with the cancellation policy.
Reducing the number of nights or guests may be treated as a partial cancellation and may therefore be subject to the applicable cancellation charges.
Reservations and deposits may not be transferred to another person without prior written approval.
6. Bookings through third parties
Reservations made through Booking.com, Airbnb, Expedia or any other booking platform are subject to the payment and cancellation terms shown on that platform at the time of booking.
Where the platform’s terms differ from these terms for direct bookings, the terms of the platform reservation take precedence.
Changes or cancellations of platform reservations must normally be processed through the same platform.
7. Check-in and check-out
Check-in is possible from 2:00 p.m.
Check-out must be completed before 11:00 a.m.
Guests are asked to share their expected arrival time and flight details before arrival.
Early check-in and late check-out are subject to availability, prior approval and possible additional charges. They cannot be guaranteed.
Guests may be asked to show valid identification at check-in and to complete a guest registration form.
8. Occupancy and visitors
Only registered guests included in the reservation may stay overnight on the property.
The maximum number of guests for the reserved room or studio may not be exceeded.
Visitors are permitted only with prior approval from Hibiscus Beach House. Unregistered visitors may not stay overnight or use the pool or other guest facilities without permission.
Parties, events, commercial activities and large gatherings are not permitted.
9. House rules
Guests are asked to respect the quiet atmosphere of Hibiscus Beach House and must not cause excessive noise or disturb other guests or neighbours.
Smoking and vaping are not permitted in the rooms, studios or other indoor areas. Smoking is permitted only in designated outdoor areas.
Illegal substances, dangerous objects and unlawful activities are strictly prohibited.
Guests must use the accommodation, furnishings and facilities responsibly and follow reasonable instructions from the owners or staff.
Pets are not permitted unless express written permission has been given before arrival.
Hibiscus Beach House reserves the right to end a guest’s stay without refund in the event of serious misconduct, threatening behaviour, illegal activity, repeated nuisance, deliberate damage or a serious breach of these terms.
10. Swimming pool
The pool is open daily from 8:00 a.m. to 6:00 p.m.
The pool is unsupervised and its use is entirely at the guest’s own risk. Diving, running, glassware and unsafe behaviour around the pool are not permitted.
Only registered guests may use the pool, unless permission has been given in advance.
Hibiscus Beach House may temporarily restrict access to the pool for maintenance, cleaning, safety reasons or circumstances beyond its control.
11. Breakfast and dietary requirements
Breakfast is included with room reservations and is served between 8:00 and 10:00 a.m.
Breakfast is not included with studio apartment reservations. Studio guests can book breakfast separately, subject to availability, at an additional charge of US$ 22 per person per day.
Guests must inform Hibiscus Beach House of any allergies or dietary requirements before arrival. Reasonable efforts will be made to accommodate these, but specific products, fully allergen-free preparation or complete protection against cross-contamination cannot be guaranteed.
12. Cleaning, towels and linen
Cleaning, towel changes and linen changes are carried out according to the service schedule that applies to the reserved accommodation.
Guests must allow reasonable access to the accommodation for agreed cleaning, maintenance, repairs or urgent inspections.
Additional cleaning or extra linen changes can be requested, subject to availability, at an additional charge of US$ 22 per person per day.
If a room or studio is left excessively dirty or requires cleaning beyond normal use, the additional cleaning costs may be charged to the guest.
13. Damage, loss and keys
The guest is responsible for damage, loss or excessive cleaning caused by the guest, accompanying guests or approved visitors.
Damage or defects must be reported immediately. Guests may not carry out or arrange repairs themselves without prior permission.
The cost of repairing or replacing damaged or missing property, including lost keys or access devices, may be charged to the guest.
Payment of such costs remains due even when the damage or loss is discovered only after departure.
14. Personal belongings and security
Guests are responsible for their own money, travel documents, vehicles and personal belongings.
Hibiscus Beach House is not responsible for loss, theft or damage to personal belongings, unless directly caused by demonstrable negligence on the part of Hibiscus Beach House.
Guests must lock their accommodation and store their personal belongings securely when leaving the property.
Items found after departure may be kept temporarily. Shipping and handling costs for returning these belongings are for the account of the guest.
15. Maintenance and temporary interruptions
Guests must report defects, damage or service interruptions as soon as possible, so that Hibiscus Beach House has a reasonable opportunity to resolve the issue.
Temporary interruptions of electricity, water, internet, air conditioning or other services may occur as a result of island-wide outages, weather conditions, maintenance or circumstances beyond the control of Hibiscus Beach House.
Reasonable efforts will be made to restore affected services, but uninterrupted availability cannot be guaranteed.
16. Additional services and third-party providers
Airport transfers, car rental, tours, excursions, boat trips and other additional services are subject to availability and may be carried out by independent third-party providers.
Unless Hibiscus Beach House provides the service directly, the third-party provider’s own terms, cancellation rules and liability provisions apply.
Hibiscus Beach House is not responsible for changes, cancellations, delays, accidents or shortcomings attributable to an independent provider.
17. Force majeure
Hibiscus Beach House is not liable for failure or delay in performing its obligations as a result of circumstances beyond its reasonable control, including natural disasters, extreme weather, government restrictions, epidemics, utility failures, civil unrest, disruption of transport or other situations of force majeure.
If Hibiscus Beach House cannot provide the reserved accommodation, it will, where reasonably possible, offer a suitable alternative or refund the amount paid for the accommodation that cannot be provided.
Hibiscus Beach House is not responsible for consequential costs, such as flight tickets, alternative transport, insurance costs or other travel arrangements.
A guest’s inability to travel does not automatically constitute force majeure for Hibiscus Beach House and remains subject to the cancellation policy. Travel insurance is therefore strongly recommended.
18. Complaints
Any complaint or problem must be reported during the stay, as soon as reasonably possible, so that Hibiscus Beach House has the opportunity to investigate and resolve it.
Complaints raised only after departure may be harder to verify and do not automatically give rise to compensation.
19. Privacy
Personal data provided by guests is used to manage the reservation, deliver the booked services, process payments, meet legal obligations and provide necessary information about the stay.
Personal data is not sold and is shared with third parties only where this is reasonably necessary to deliver the requested services or to comply with legal obligations.
20. Governing law
These terms and conditions and the reservation agreement are governed by the law of Curaçao.
The parties will first try to resolve any dispute amicably. If that is not possible, the dispute may be submitted to the competent court in Curaçao.
